County Mourning Passing of Judge
Final Rites Today

Funeral services are being held this afternoon at the San Rafael Presbyterian Church for Judge Herbert De La Montanya, justice of peace of San Rafael township for over 25 years, who passed away Tuesday in a local hospital after an illness which had confined his actions for some time.

Judge De La Montanya, born 75 years ago in San Francisco, was the son of the late Hudson De La Montanya. Starting his career in this county many years ago, the well liked and respected San Rafael resident was a prominent member of the San Rafael Lodge of Elks and Mira Monte Camp W.O.W.

Studying law in his youth he was admitted to the California State Bar, but centered a good deal of his early activity about the collection of news in this county as a representative of San Francisco papers. He took over the position of judge of the San Rafael Township, which includes Fairfax, San Anselmo, Ross, Kentfield, Larkspur, Corte Madera, San Quentin, San Rafael and the surrounding area, shortly after World War I, and since that time remained uncontested in his office.

During his term of office the San Rafael court, over which he presided, was made the only Class A Justice Court in Marin county, thereby expanding its scope. Meanwhile he also served as inheritance tax court adjustor as well as being the “marrying man” for the area.

The deceased is survived by his wife, Mrs. Catherine De La Montanya; five sons, well known in this county, Lloyd De La Montanya, Marin County fire chief; Herbert, Dean, Nicholas and James De La Montanya, the latter serving as an officer with the Merchant Marine.

Following the rites, which are being attended by friends of “the Judge” from all parts of Marin as well as county and city dignitaries, interment will be held at Mt. Tamalpais cemetery.
