Husband Seeks Revocation Of Wife’s Last Will

In an effort to revoke his wife’s will which bequeathed to her spiritual advisor the property which he alleges had been previously left to him, Geo. H. Roberts of Mill Valley has filed a contest against the executor of the estate of the late Mrs. Theresa Zerman Roberts, the bulk of which she left to Rev. and Mrs. Byron E. Paddock.

Roberts states that after his marriage in May 1919 he and Mrs. Roberts purchased property in their joint name. There was an agreement that Roberts should build a new house and take charge of five other dwellings on the property. In the event of Mrs. Roberts’ death the entire estate should go to Roberts. The plaintiff alleges that a will was made to this effect, but that on August 27, 1920, some weeks later, it developed, another will had been made in favor of Paddock and his wife, The latter will has been filed for probate by Charles H. Huntoon, named as executor. Attorney George H. Harlan represents Roberts.

Roberts charges that advantage was taken of Mrs. Roberts’ weak mental condition to induce her to change her bequest.
