Estate Of Dead Couple: Half And Half

If a person kills his spouse and then commits suicide, his heirs are entitled to only one-half the community property owned by the dead couple, a Marin judge ruled yesterday.

Judge Thomas F. Keating of Marin Superior Court so ruled in the dispute over the estate of he late Ralph C. and Jean E. Sooy, who lived at 386 Throckmorton Avenue in Mill Valley until their violent deaths last December.

Sooy shot and killed his wife on Dec. 28, then turned the gun on himself. He died the next day.

Sooy’s brother, James L. Sooy, petitioned Marin Superior Court for the entire estate. Frank J. Keaton, administrator for the estate of Mrs. Jean E. Sooy, objected on grounds that Sooy is not entitled to his wife’s share of community property.

Judge Keating ruled that the community property should be divided half and half.
