Marin Miller Heir Due ‘Only’ $5 Million

Because a judge’s ruling went against her and others on her side in a lengthy trust battle, a San Rafael woman will receive “only” five million dollars.

Mary Nikel Lobardi of 25 Palm Avenue, San Rafael, is a great-granddaughter of Henry Miller, California cattle king, who established a trust in 1913 three years before his death.

The trust did not spell out how the stock in Miller and Lux, Inc. should be divided. Yesterday, Judge Joseph Karesh of San Francisco Superior Court ruled that the 40 million dollar trust should be split equally between two families.

Members of the Bowles family will divide their half of the estate three ways, while members of the Nickel family will have a smaller share because they have a four-way split.

The Nickel heirs had contended through their attorneys that the stock should be split seven ways with each of seven heirs getting an equal share. The Nickel attorneys said yesterday that the judge’s ruling would be appealed.
